This document  (“Privacy Policy”) describes rights and obligations of spaceti s.r.o., a limited liability company organized and existing under the laws of the Czech Republic, with its registered office at Jungmannova 36/31, Nové Město, Postal Code 110 00 Prague 1, Czech Republic, ID No.: 05137659, registered in the Commercial Register administered by the Municipal Court in Prague, Section C, File 258845 (“we” or “us”) as required by the General Data Protection Regulation (EU) (2016/679) and respective national laws (the “Data Protection Legislation”) and rights and obligations of individuals consuming the services provided by us.

This Privacy Policy has been compiled to describe how we process personal data of our users (“you”), as they are defined by the Data Protection Legislation (the “Personal Data”), when you access our web site or use Dashboard or Mobile app (together “Service”). Please read our Privacy Policy carefully to get a clear understanding of how we collect, use, protect or otherwise handle your Personal Data when providing our Services.

WHAT PERSONAL DATA DO WE PROCESS AND ON WHAT LEGAL GROUNDS?

We shall process your Personal Data on the basis for the COMPLIANCE with our LEGAL OBLIGATIONS or for our LEGITIMATE INTERESTS, to achieve the following purposes:

    1. Provide you with the communication and the Service;
    2. Confirm or correct your Personal Data;

    1. provide you with the navigation in the monitored building (accessible to you via Dashboard or Mobile app) and other localization based functionalities;
    2. make possible personalisation of the Service
    3. provide you with search feature of other individuals (e.g. co-workers) in the monitored building;
    4. enable reporting of damaged equipment or facilities in the monitored building

You have the right to withdraw your consent at any time, without affecting the lawfulness of processing of your Personal Data based on consent before its withdrawal. However, in that case we are not able to provide you some features of the Service.

 

HOW DO WE PROTECT YOUR PERSONAL DATA?

Our data processing is fully consistent with the Data Protection Legislation as we implement a variety of technical and organisational security measures to maintain the safety of your Personal Data.

Your Personal Data is contained behind secured networks protected by up-to-date antivirus software with a password-protected access to the storage and is only accessible by a limited number of persons who have special access rights to such systems and are required to keep the information confidential.

 

THIRD-PARTY DISCLOSURE

We do not sell, trade, or otherwise transfer to outside parties your Personal Data. However, when localization based functionalities are a part of the Service, your name and your location inside the monitored building may be accessible in real time to other users of the Service (if actively allowed by you in Mobile app) with respect to the relevant building(s) monitored under one contract or related contracts concluded between us as a Service provider and our customer who ensures provision of the Service to you.

We may engage selected third party companies and individuals to perform services complementary to our Service, namely – cloud-hosted document storage, data analytics, consulting, support, data and cyber security. These Service Providers may have access to your Personal Data, depending on each of their specific roles and purposes in facilitating and enhancing our Service, and may only use it for such purposes. Before sharing your Personal Data, we ensure that the third parties receiving the personal information have provided appropriate safeguards, and that your privacy rights are protected and preserved.

For the technical provision of our Service, we use server services from Amazon Web Services EMEA SARL, 5 Rue Plaetis, L-2338 Luxembourg (“AWS”), which processes our data on our account. Data processing by AWS takes place in a computer centre within the EU. AWS is contractually committed to us to provide an appropriate level of data protection in accordance with the EU standard contractual clauses. HOW LONG DO WE PROCESS YOUR DATA?

We process all Personal Data only in a scope necessary for the purposes listed above and only for such time as shall be necessary for the fulfilling of the purposes, unless required otherwise by applicable legal regulations. We will retain your Personal Data that are necessary to provide you with the Service for as long as your account is active, and to comply with our legal obligations, resolve disputes, and enforce our Terms of Use. After you close your account, we may retain your Personal Data for up to fifteen (15) calendar days to allow us a reasonable time to properly close your account. Notwithstanding the foregoing, if longer retention of certain data is required under applicable law, we will retain such data for such longer period of time. Once this period has expired, we will delete your data.

We will also delete all data processed based on your consent immediately after your consent is revoked.

  3. The right to data portability
    You may request your set of your Personal Data be transferred to another controller or processor, provided in a commonly used and machine-readable format. This right is only available if (i) the original processing of the respective Personal Data was on the basis of your consent or is based on the fulfilment of a contractual obligation towards you, and (ii) the processing is by automated means.
  4. The right to erasure
    Where no overriding legal basis or legitimate interest continues to exist for processing your Personal Data, you may request that we delete the Personal Data. We will take all reasonable steps to ensure erasure.
  5. The right to restrict processing
    You may ask us to stop processing your personal data, on reasonable grounds relating to your particular situation, unless the processing is required by law.
