POLÍTICA DE PRIVACIDAD

Esta Política de Privacidad (en adelante, la “Política”) rige para el acceso y uso de la aplicación “THE MUSIC STATION” (la “Aplicación”), con la que se gestiona el acceso y ocupación de las oficinas, salas, parking y/o estudio de grabación del complejo de Príncipe Pío (conjunta e indistintamente, las “Instalaciones”) que tienen WARNER MUSIC SPAIN, S.L. (en adelante, “WMS”) y otras compañías de su grupo (todos ellos conjuntamente, “WMGES” o “Nosotros”).

Al utilizar la Aplicación, nos confías tus datos, y como sabemos que es una gran responsabilidad y nos esforzamos en proteger tu información, queremos que conozcas los detalles sobre cómo lo hacemos.

Estas condiciones serán efectivas desde el día 15 de febrero de 2022 y el contenido de esta Política es el siguiente:

1. INTRODUCCIÓN Y CORRESPONSABLES DEL TRATAMIENTO

Esta Aplicación administra el acceso a las oficinas que en Príncipe Pío compartimos las siguientes compañías:

  • WARNER MUSIC SPAIN, S.L., con domicilio social en The Music Station – Príncipe Pío, Cta. San Vicente, 44, Torre Levante, 28008 (Madrid) y C.I.F. B-08694523 (“WMS”).

  • WARNER CHAPPELL MUSIC SPAIN, S.A., con domicilio social The Music Station – Príncipe Pío, Cta. San Vicente, 44, Torre Levante, 28008 (Madrid) y C.I.F. A-28104347..

  • PROMOCIONES MUSICALES GET IN, S.L.U., con domicilio social en C/ Portuetxe 53ª – of 305, 20018 San Sebastián (Guipúzcoa) y C.I.F. B-20981593..

  • NEWISCOM, S.L.U, con domicilio social en C/ Nuestra Señora del Carmen, 11, 28250 Torrelodones (Madrid) y C.I.F. B-80091408..

Todas las mencionadas compañías, pertenecientes al grupo Warner, somos conjuntamente responsables de este tratamiento (en adelante “WMGES” o ”Nosotros”), si bien es WMS quien gestiona la Aplicación para todos Nosotros. Eso significa que las anteriormente mencionadas compañías se han puesto de acuerdo en realizar conjuntamente este tratamiento de datos para las finalidades dispuestas más abajo y que cada una de ellas podrá usar los datos respecto de sus propios empleados, proveedores y/o visitantes a los efectos de gestionar la provisión de recursos y/o medios a los mismos y facilitar la interacción entre los mismos (ya sea compartiendo localizaciones y/o avisos o comunicaciones, tal y como se describe más abajo); si bien toda lagestión de los Datos, hasta que sean utilizados por los corresponsables de esta manera, se realizará por WARNER MUSIC SPAIN, S.L. (“WMS”), titular de las instalaciones; quien asimismo será el único de los responsables que trate los datos a los efectos de gestionar la optimización de las instalaciones y control de acceso.

Respetamos tu privacidad, como la de todas aquellas personas de quienes, a través de cualquier sistema, recabamos cualesquiera datos e información que se asocien o se puedan asociar a las mismas (los “Datos Personales” o, simplemente, los “Datos”).

Esta Política la aplicamos a todos los Datos que, durante el proceso de registro y en el transcurso de tu navegación por la Aplicación, nos hayas facilitado o hayamos recabado.

2. PROCESO DE REGISTRO Y BAJA

Esta Aplicación va destinada tanto a nuestros trabajadores y proveedores, como a fans y visitantes en general. Así, para poder hacer uso de las posibilidades que te ofrece, deberás seguir los siguientes pasos:

  • Descárgate la Aplicación: Podrás efectuar su descarga desde la Appstore de (para dispositivos Apple, funcionando bajo el sistema operativo I.OS) o bien desde la plataforma Google Play (para dispositivos que utilicen el sistema operativo Android).

  • Regístrate (alta/creación de cuenta de usuario): Deberás completar el formulario correspondiente incluyendo los Datos que se te soliciten, así como leer y aceptar los Términos y Condiciones de la Aplicación y la presente Política de Privacidad. Con ello nos estarás dando tu consentimiento para posibilitarte el acceso y uso de la Aplicación y tratar tus Datos Personales en la medida necesaria para ello. Debes tener más de 14 años para registrarte en esta Aplicación.

Para darte de alta, y como requisito contractual, es necesario que rellenes todos los campos de la sección “Registrarse”; y si no lo haces no podrás utilizar la Aplicación ni reservar recursos a través de la misma.

  • Comunicaciones promocionales y comerciales: Si te interesa estar al día de las principales novedades de la comunidad WMGES (próximos conciertos de nuestros artistas, grabación y/o publicación de nuevas canciones, celebración de eventos promocionales, etc.), te daremos la oportunidad de prestarnos tu consentimiento para recibir esta información, en caso contrario, la Aplicación no te enviará más comunicaciones que las relativas a la operación de las Instalaciones.

  • Acceso a módulos: A través de la Aplicación podrás acceder a módulos que te permitan a Servicios para reservar de puesto de trabajo, sala de reuniones, parking, solicitar autorización para usar un estudio de grabación (no conlleva reserva automática, sino que su aprobación dependerá del cumplimiento de determinados requisitos y formalidades); recibir y ver noticias y notificaciones; o ver el mapa de las Instalaciones. En función de tu perfil de usuario (por ejemplo, no será igual el de empleados que el de visitantes), laAplicación te permitirá acceder al módulo o módulos pertinentes. En cada uno de ellos se te facilitarán las indicaciones necesarias para que puedas utilizarlo de la manera más provechosa, podrá pedirte Datos adicionales y asimismo se te ofrecerá la posibilidad de hacer uso de la Aplicación de manera anónima frente a otros usuarios.

  • Baja de la Aplicación: Si desearas darte de baja de la Aplicación, podrás hacerlo en cualquier momento eliminándola de tu dispositivo, si bien sin ella no podrás acceder a las Instalaciones.

3. RECOGIDA DE TUS DATOS: CATEGORÍAS

Trataremos los Datos que tú nos facilites a través de tu registro (como datos identificativos, de puesto o rol -proveedor, cliente, empleado, artista, autor, manager o miembro de la prensa-). Además de los Datos que tú mismo nos facilitas al registrarte, trataremos también tus Datos de acceso a las Instalaciones, incluyendo momento en el que accedes, uso de las mismas, localización en las Instalaciones, y comunicaciones. La fuente de estos datos será tu uso de la Aplicación y tu interacción con WMGES a través de la misma.

4. TRATAMIENTO DE TUS DATOS: FINALIDADES Y LEGITIMACIÓN.

Trataremos tus Datos para gestionar las funcionalidades de esta Aplicación y, con carácter general, para las siguientes finalidades:

(i) Para gestionar tu uso de las Instalaciones y los recursos que ponemos a tu disposición como empleado, cliente o proveedor nuestro, o bienpara gestionar tu solicitud de acceso a dichos recursos:

Como empleado de cualquiera de las compañías que conforman WMGES, tienes derecho a acceder a determinadas instalaciones y recursos dentro de las Instalaciones (tales como taquillas, espacios de aparcamiento, puestos de trabajo, salas de reuniones y/o estudios de grabación). Usamos tus Datos a través de la Aplicación, principalmente, para gestionar cómo te facilitamos dicho acceso de forma ordenada.

Si eres cliente o proveedor nuestro (por ejemplo, porque eres uno de nuestros artistas) también es posible que te permitamos utilizar alguna de esas Instalaciones (como, por ejemplo, un estudio de grabación). En este caso utilizaremos tus datos para gestionar tu solicitud de uso de tal Instalación, concedértela o denegártela y, en su caso, gestionar la puesta a disposición de dicha instalación a través del oportuno contrato.

La base legal para todo ello será la gestión de la relación contractual que tengas con la compañía del grupo WGMES de la que seas empleado, cliente o proveedor. En el caso de que solicites el uso de una sala de grabación a través del módulo dispuesto al efecto en la Aplicación, nuestra legitimación para tratar tus datos derivará de la necesidad de realizar gestiones pre-contractuales derivadas de tu solicitud y, una vez que, en su caso, se te otorgue el uso de la sala, de la gestión del oportuno contrato por el que se te concederá dicho uso.

(ii) Para controlar accesos a las Instalaciones y garantizar su seguridad:

También usaremos tus Datos para comprobar tu identidad, como la de todas las personas que acceden a Nuestras Instalaciones, controlar los accesos a las Instalaciones y garantizar la seguridad tanto de las mismas como de las personas y recursos que se contienen en su interior.

La base legal para ello será nuestro interés legítimo en proteger nuestras instalaciones, y bienes empresariales, así como en procurar la seguridad de nuestros empleados y demás visitantes.

(iii) Para permitirte tanto a ti como a otros usuarios el disfrute de todas las funcionalidades de la Aplicación:

En este sentido, utilizamos tus Datos para permitir la navegación en Nuestras Instalaciones, permitir la búsqueda de otras personas (por ejemplo, compañeros de trabajo) en las mismas (siempre que dichas personas hayan habilitado tal posibilidad), reportar equipos o infraestructuras dañadas y recibir comunicaciones operativas respecto de las Instalaciones (tales como cierres, avisos de simulacros de incendio, etc.).

La base legal para todo ello será nuestro interés legítimo en optimizar el uso de la Aplicación y las Instalaciones para los usuarios y facilitar interacción entre los empleados (así como la relación entre los empleados, proveedores y otros visitantes). No obstante esta base legítima, todos los usuarios podrán en cualquier momento deshabilitar o habilitar, en su perfil, la funcionalidad que les permite ser localizados en las Instalaciones por otros usuarios.

(iv) Para optimizar el uso y aprovechamiento de Nuestras Instalaciones:

Usaremos tus Datos para elaborar informes de mantenimiento, sugerencias de uso del espacio, análisis de uso del espacio y otros tipos de informes relacionados con Nuestras Instalaciones.

La base legal para ello será nuestro interés legítimo en optimizar el uso de la Aplicación entre los usuarios y en asegurar una gestión eficiente de la misma. En cualquier caso, los Datos que se usen para esta funcionalidad estarán previamente anonimizados.

(v) Para proporcionarte nuestras Newsletters u otros materiales de marketing:

Solo en el caso de hayas dado tu consentimiento para ello en tu perfil al registrarte, podremos enviarte comunicaciones de marketing sobre contenidos e información adicional relativos a las actividades y productos de WMGES que puedan ser de tu interés, si has indicado que te interesa recibirlas (inclusive, sin limitación a través de nuestros proveedores de servicios que envían correo directo, emails u otro tipo de publicidad).

La base legal para ello será tu consentimiento, que podrás retirar en cualquier momento poniéndote en contacto con Nosotros según te indicamos más abajo o modificando esta posibilidad en tu perfil de la Aplicación.

En ningún caso usaremos tus Datos para la toma de decisiones automatizadas o la elaboración de perfiles.

5. PLAZO DE CONSERVACIÓN DE TUS DATOS

Trataremos tus Datos durante el tiempo por el que resulten necesarios para cumplir las finalidades descritas en esta Política y, más allá, los conservaremos hasta que hayan transcurrido tanto los plazos por los que las Leyes aplicables nos obliguen a conservarlos, como también los plazos de prescripción de cualesquiera acciones legales para las que pudieran ser pertinentes dichos Datos o los documentos que los contienen.

En todo caso:

  • los datos relativos a tu acceso a las Instalaciones, salvo que resulten pertinentes para cualquier investigación relativa a un incidente que afecte a la seguridad en dichas instalaciones, se eliminarán o anonimizarán pasando 30 días desde dicho acceso (por lo que en ningún caso mantendremos esos datos de forma que se te pueda identificar);

  • mantendremos tus datos de registro en la Aplicación hasta que manifiestes tu oposición en la manera que se dispone más adelante (Artículo 10), a los efectos de facilitar cualquier entrada que en el futuro quieras hacer en las Instalaciones; y

  • cuando el tratamiento esté legitimado por tu consentimiento conservaremos los Datos hasta que manifiestes tu deseo de revocar dicho consentimiento en la manera que se dispone más adelante (Artículo 10).

6. DESTINATARIOS DE LA INFORMACIÓN

Además de a la administración y a las autoridades públicas, a las cuales podremos ceder tus Datos en la medida en que la Ley nos obligue a ello (sobre la base jurídica de tal obligación) o sea necesario y/o conveniente para la defensa de nuestros legítimos derechos (sobre la base de nuestro interés prevalente en la defensa de dichos derechos), podemos dar acceso a tus Datos:

  • Como parte de una operación societaria: Podemos compartir tus Datos como parte de una operación societaria, así como en relación con o durante la negociación de cualquier fusión, venta de activos de la empresa, financiación o adquisición de la totalidad o parte de nuestro negocio. La base legal para tal comunicación será nuestro interés legítimo en asegurar el desarrollo y/o ejecución de la operación.

  • A nuestros proveedores de servicios para facilitar el servicio que proporcionan: dichos proveedores tendrán acceso como meros encargados del tratamiento, de conformidad con las garantías legalmente aplicables, y podrán ser proveedores de servicios tales como la gestión de la Aplicación, hosting (el lugar donde guardamos los Datos); auditoría; asesoramiento jurídico; análisis de Datos; provisión de infraestructura; servicios informáticos o de seguridad, entre otros.

7. TRANSFERENCIAS DE DATOS

No transferiremos tus Datos Personales fuera de la Unión Europea o del Espacio Económico Europeo.

8. TUS DERECHOS

Tienes derechos relacionados con los Datos Personales que tenemos sobre ti:

  • Derecho a confirmar si estamos tratando o no Datos Personales que te conciernan, y, en tal caso, solicitar el acceso a los mismos y obtener una copia de los Datos Personales objeto de tratamiento.

  • Derecho a solicitar su rectificación cuando tengamos Datos Personales incompletos o inexactos.

  • Derecho a solicitar su supresión cuando los Datos ya no sean necesarios en relación con los fines para los cuales fueron recogidos o tratados de otro modo; cuando hayas retirado tu consentimiento y el tratamiento no se fundamente en otra base jurídica; o te opongas al tratamiento porque este se fundamentaba en el interés legítimo o en el cumplimiento de una misión de interés público, y no han prevalecido otros motivos para legitimar el tratamiento de tus Datos.

  • Derecho a solicitar la limitación de su tratamiento.

Cuando impugnes la exactitud de los Datos, durante un plazo que nos permita su verificación o cuando te hayas opuesto al tratamiento de tus Datos Personales que realizamos con base en el interés legítimo o misión realizada en interés público, mientras verificamos si estos motivos prevalecen sobre los tuyos.

Cuando consideres que el tratamiento es ilícito y te hayas opuesto a la supresión de tus datos o cuando ya no necesitemos tus Datos Personales para los fines del tratamiento, pero tú los necesites para la formulación, el ejercicio o la defensa de reclamaciones.

  • Oponerte al tratamiento cuando tus Datos Personales sean objeto de tratamiento en el marco de una misión realizada en interés público, basado en el interés legítimo o que tenga por objeto la mercadotecnia directa, incluida la elaboración de perfiles en cualquiera de dichos casos, en cuyo caso dejaremos de tratar tus Datos, salvo que concurran motivos imperiosos que prevalezcan sobre tus intereses, derechos y libertades, o para la formulación, el ejercicio o la defensa de reclamaciones.

También podrás oponerte al tratamiento cuando este tenga como finalidad la mercadotecnia directa, incluida también la elaboración de perfiles en la medida en que esté relacionada con la citada mercadotecnia, en cuyo caso dejaremos de tratar tus Datos para estos fines

  • Derecho a la portabilidad de los Datos que nos hayas facilitado, cuando el tratamiento esté basado en tu consentimiento o en un contrato y el tratamiento se efectúe por medios automatizados, en cuyo caso procederemos a entregarte los Datos en un formato estructurado, de uso común y lectura mecánica y, cuando sea técnicamente posible, atransmitir tus Datos al responsable que nos indiques.

  • Derecho a retirar tu consentimiento en cualquier momento, sin que ello afecte a la licitud del tratamiento previo basado en el consentimiento con anterioridad a su retirada.

  • Derecho a oponerte a la toma de decisiones automatizadas.

Para ejercitar estos derechos, podrás dirigirte a Nosotros en la dirección indicada más abajo, en la Sección 11. En todo caso, deberás demostrar tu identidad mediante fotocopia de tu DNI u otro documento que acredite tu identidad adjuntándola a tu comunicación, ya sea por correo electrónico, presencialmente o por correo ordinario, y el derecho o derechos que desees ejercer.

Asimismo, en caso de considerar que en el tratamiento de tus Datos se ha vulnerado la normativa en materia de protección de datos, tienes derecho a presentar una reclamación ante cualquier autoridad de control europea (cuya lista puedes encontrar aquí) incluida la Agencia Española de Protección de Datos (AEPD), si bien te animamos a que primero nos permitas ayudarte.

9. ACTUALIZACIONES DE NUESTRA POLÍTICA

Esta Política de Privacidad puede actualizarse periódicamente para reflejar cambios en nuestras prácticas sobre Datos Personales. Cualquier cambio en la Política se anunciará con 15 días de preaviso a la efectividad de dichos cambios. Publicaremos un aviso destacado para notificarte cualquier cambio significativo en ella e indicaremos en la parte superior de la Política cuándo se actualizó por última vez. Te recomendamos que consultes periódicamente la Política

Podrás ponerte en contacto con cualesquiera de los responsables miembros de WMGES en las direcciones que, para cada uno, aparecen al principio de esta política.

Asimismo, ante cualquier duda sobre esta Política y/o para ejercer cualquiera de tus derechos (aunque sea respecto de únicamente uno de los responsables) podrás ponerte en contacto con Nosotros a través del Delegado de Protección de Datos de WMS en la dirección indicada en la Introducción para WMS o en el correo electrónico Valeria.rapetti@warnermusic.com.

This Privacy Policy (hereinafter, the “Policy”) applies to access and use of the “THE MUSIC STATION” Application (the “Application”), which administers access to and occupation of offices, rooms, car park and/or recording studio at the Príncipe Pío complex (jointly and severally, the “Facilities”), owned by WARNER MUSIC SPAIN, S.L. (hereinafter, “WMS”) and other companies in the WMS group (hereinafter jointly referred to as “WMGES” or “us”).

By using the Application, you entrust your data to us, and because we know what a great responsibility this is and will therefore make every effort to protect your information, we want you to know exactly how we do it.

These conditions will come into effect on 15 February 2022, and the table of contents of this Policy is as follows:

1. INTRODUCTION, AND PARTIES JOINTLY RESPONSIBLE FOR HANDLING AND PROCESSING THE DATA

This Application administers access to the offices at Príncipe Pío which we share with the following companies:

  • WARNER MUSIC SPAIN, S.L., a company having its registered address at The Music Station – Príncipe Pío, Cta. San Vicente, 44, Torre Levante, 28008 (Madrid) and holding Tax Identification Code [Código de Identificación Fiscal/CIF] no. B-08694523;

  • WARNER CHAPPELL MUSIC SPAIN, S.A., a company having its registered address at The Music Station – Príncipe Pío, Cta. San Vicente, 44, Torre Levante, 28008 (Madrid) and holding Tax Identification Code no. A-28104347;

  • PROMOCIONES MUSICALES GET IN, S.L.U., a company having its registered address at C/ Portuetxe 53ª – OF 305, 20018 San Sebastián (Guipúzcoa) and holding Tax Identification Code no. B-20981593; and,

  • NEWISCOM, S.L.U, a company having its registered address at C/ Nuestra Señora del Carmen, 11, 28250 Torrelodones (Madrid) and holding Tax Identification Code no. B-80091408.

Although all the above companies in the Warner group (hereinafter, “WMGES” or ”us”) are jointly responsible for handling and processing the data, it is WMS that manages the Application for all of us. This means that the above-mentioned companies have agreed to carry out data-handling and -processing jointly for the purposes outlined below, and that each of them can use the data in respect of its own employees, suppliers and/or visitors for the purposes of managing the supply of resources and/or means to such persons and facilitating interaction among them (whether by sharing locations and/or notices or messages, as described below). Nonetheless, the overall management of the data, until such information is used by the other co-responsible parties in the above manner, will be undertaken by WMS, the owner of the Facilities, which will likewise be the sole co-responsible party in charge of handling and processing the data for the purpose of achieving optimisation of the Facilities and ensuring control of access.

We respect your privacy and that of everybody else from whom, using any system, we gather data and information which are or can be linked to them (“Personal Data” or simply “Data”).

This Policy will apply to all Data which you may have supplied to us or we may have gathered during the signing-up process and in the course of your browsing through the Application.

2. CREATING AND CLOSING YOUR ACCOUNT

This Application is targeted at our employees and suppliers, as well as at fans and visitors in general. To make use of the possibilities that it offers, you must therefore go through the following steps:

  • Download the Application: you’ll be able to download it from the Appstore (for Apple devices, working under the I.OS operating system) or from the Google Play platform (for devices that use the Android operating system).

  • Registration (sign-up/creation of user account): you must fill in the relevant form, including the required Data, and read and accept the Terms and Conditions of the Application and this Privacy Policy. By doing so, you will be giving us your consent to let you access and use the Application, and handle and process your Personal Data insofar as this is necessary. You must be over 14 years of age to register for this Application.

In order to sign up, and as a contractual requirement, you’ll have to fill in all the fields in the “Sign-up” section. If you don’t do so, you won’t be able to use the Application or reserve resources through it.

  • Promotional and commercial communications: if you wish to keep up to date with all the main news about the WMGES community (upcoming concerts of our artists, recording and/or release of new songs, holding of promotional events, etc.), we’ll give you the chance to consent to receiving such information. If you don’t, the Application won’t send you items of news or information other those that concerning the operation of the Facilities.

  • Access to modules: via the Application you’ll be able to access modules which provide you with a range of services, namely: to reserve a workplace, meeting rooms, car park; to request authorisation to use a recording studio (this does not amount to an automatic booking: it means that approval will depend on compliance with certain requirements and formalities); to receive and see news and notifications; or, to seethe map of the Facilities. Depending on your user profile (for instance, an employee’s profile will not be the same as a visitor’s), the Application will allow you to access the relevant module or modules. In each of these, you’ll be given the necessary indications to enable you to use it most advantageously: you’ll be able to request additional Data, and similarly, you’ll be offered the possibility of making use of the Application anonymously vis-à-vis other users.

  • Deactivating the Application: if you wish to deactivate the Application, you can do so at any time by simply deleting it from your device, though without it you won’t be able to access the Facilities.

3. COLLECTING YOUR DATA: CATEGORIES

We will handle and process the Data that you supply to us when you register (such as data regarding your identity, position or role -supplier, customer, employee, artist, author/composer, manager, or member of the press). In addition to the Data that you yourself provide on signing up, we will also handle and process your Data for accessing the Facilities, including your entry time, use of the Facilities, location within the Facilities, and messages. The source of this information will be your use of the Application and your interaction via it with WMGES.

4. HANDLING AND PROCESSING YOUR DATA: PURPOSES AND LEGAL BASIS

We will handle and process your Data in order to manage the functionalities of this Application and, in general, for the following purposes:

(i) To manage your use of the Facilities and the resources that we place at your disposal, as our employee, customer or supplier, or to manage your request to access these resources:

As an employee of any of the companies that make up WMGES, you have the right to access certain installations and resources situated within the Facilities (such as lockers, parking spaces, workplaces, meeting rooms and/or recording studios). Via the Application, we basically use your Data to manage how to give you access in the best-organised way.

If you are our customer or supplier (e.g., because you are one of our artists), it’s also possible that we may allow you to use some of these Facilities (such as a recording studio). In this case, we’ll use your information: to process your request to use that Facility; to grant or reject the request; and, where applicable, to arrange for the Facility to made available to you under the relevant agreement.

The legal basis for all the above is the management of the contractual relationship that you have with the specific WGMES company of which you are an employee, customer or supplier. Should you request the use of a recording studio via the module provided for that purpose in the Application, the legal grounds for handling and processing your data will flow from the need to make pre-contractual arrangements arising from your request, and if and when you are given permission to use the studio, from the need to attend to the formalitiessurrounding the relevant agreement under which such use is then granted to you.

(ii) To control access to the Facilities and guarantee your security:

We will also use your Data: to check your identity, as well as that of all persons who enter into our Facilities; to control access to the Facilities; and to guarantee the security, both of the Facilities themselves and of the people and resources which these contain in their interior.

The legal basis for the above is our legitimate interest in protecting our Facilities and company assets, as well as ensuring the security of our employees and other visitors.

(iii) To allow you and other users full use of all the Application’s functionalities:

In this respect, we use your Data to allow you to browse through our Facilities, search for other persons (for example, work colleagues) in the Facilities (provided that such persons have enabled this possibility), report damaged equipment or fixtures and fittings, and receive operational communications regarding the Facilities (such as closures, fire-drill announcements, etc.).

The legal basis for all the above is our legitimate interest in optimising the use of the Application and the Facilities for users, and enabling interaction among employees (as well as the relationship between employees, suppliers and other visitors). Despite this legitimate basis, any user can at any time disable or enable the functionality in his/her profile which allowshim/her to be located in the Facilities by other users.

(iv) To optimise the use and enjoyment of our Facilities:

We will use your Data to draw up maintenance reports, suggestions for use of space, space utilisation analyses, and other types of reports relating to our Facilities.

The legal basis for this is our legitimate interest in optimising use of the Application by users and ensuring that it is efficiently managed. At all events, any Data used for this functionality will be previously anonymised.

(v) To provide you with our newsletters or other marketing materials:

Provided that you consented to this in your user profile when you signed up, we’ll be able to send you marketing newsletters about content and additional information relating to WMGES activities and products that may be of interest to you, if you have indicated your interest in receiving them (including, but not limited to, our service providers who send out direct mail, e-mails or other types of advertising).

The legal basis for the above will be your consent, which you can withdraw at any time by contacting us as indicated below or making the necessary change in your Application profile.

In no case, will we use your Data for automated decision-making or profiling purposes.

5. HOW LONG WE KEEP YOUR DATA

We will hold and handle your Data for as long as is necessary to achieve the purposes described in this Policy, and beyond that, we will continue to store your Data until the elapse of the mandatory statutory periods required by law and of the time limits for prescription of any legal actions for which such Data or documents that these contain might be pertinent. 

In every case:

  • Data relating to your access to the Facilities, save where these are pertinent for any investigation relating to an incident affecting the security of such Facilities, will be deleted or anonymised after the elapse of 30 days from such access (so that in no case will this information be kept in a way or form that might render you identifiable);

  • your Application sign-up information will be retained until you lodge an objection, as provided for below (Article 10), so as to make it easier for you to gain entry into the Facilities in future, should you wish to do so; and,

  • when processing and handling is rendered lawful by your consent, the Data will be stored until you express the wish to revoke such consent, as provided for below (Article 10).

6. DATA RECIPIENTS

In addition to government and public authorities to which we are able to transfer your Data insofar as the law obliges us to do so (on the legal basis of said obligation) or as may be necessary and/or convenient for the defence of our legitimate rights (on the basis of our prevailing interest in the defence of such rights), access to your Data can be given:

  • as part of a corporate operation: we can share your Data as part of a corporateoperation, and in connection with or during the course of the negotiation of any merger, sale of company assets, financing or acquisition of all or part of our business. The legal basis for such data communication would be our legitimate interest in ensuring the development and/or implementation of the operation; and,

  • to our service providers to facilitate the service that they offer: these providers will have access as mere processing operators in accordance with the legally applicable guarantees, and may be providers of services such as Application management, hosting (the site where we store the Data), auditing, legal advisory service, data-analysis, infrastructure provisioning, computer or security services, among others.

7. DATA TRANSFERS

We shall not transfer your Personal Data to anywhere outside the European Union or European Economic Area.

8. YOUR RIGHTS

You have rights relating to the Personal Data about you which is being held by us:

  • the right to confirm whether or not we are handling and processing Personal Data that concern you, and in such a case, to seek access to these and obtain a copy of the Personal Data being processed;

  • the right to seek rectification in any case where we may be holding Personal Data that are incomplete or inaccurate;

  • the right to seek erasure where the Data are no longer necessarywith respect to the purposes for which they were collected or otherwise processed; where you’ve withdrawn your consent and the handling and processing are not based any other legal grounds; or you object to the handling and processing because this was based on legitimate interest or the fulfilment of a public interest mission, and there have been no other reasons to legitimate the handling and processing of your Data;

  • the right to seek limitation of handling and processing.

In any case where you challenge the accuracy of the Data, during a period of time that allows us to check this; or in any case where you’ve objected to the handling and processing of your Personal Data, undertaken by us on the basis of legitimate interest or mission undertaken in the public interest, while we check whether such reasons override yours;

In any case where you consider that the handling and processing is unlawful and you have objected to the erasure of your information; or in any case where we no longer need your Personal Data for handling and processing purposes but you need those data for the formulation, exercise or defence of any claim;

  • the right to object to the handling and processing of your Data in any case where your Personal Data are subjected to handling and processing within the framework of a mission undertaken in the public interest, on the basis of legitimate interest, or for the ultimate purpose of direct marketing,including the drawing-up of profiles in any of these instances, in which case we shall cease handling and processing your Data, save where there are pressing reasons that prevail over your interests, rights and freedoms, or for the formulation, exercise or defence of any claim.

You can likewise object to the handling and processing of your Data in any case where this is for the ultimate purpose of direct marketing, including the drawing-up of profiles, insofar as the latter is connected with such marketing, in which case we shall cease handling and processing your Data for such purposes; 

  • the right to Data portability in respect of the information you have supplied to us, in any case where the handling and processing of your Data is based on your consent or on an agreement, and the handling and processing is performed by automated means, in which case we shall deliver the Data to you in a structured, commonly used, machine-readable format and, where technically possible, transfer your Data to any person designated for the purpose by you;

  • the right to withdraw your consent at any time, without this in any way affecting the lawfulness of any previous handling and processing based on consent given prior to such withdrawal; and,

  • the right to object to automated decision-making.

To exercise these rights, you can write to us at the address indicated below, under Section 11. In all cases, you will have to provide proof of your identity in the form of a photocopy of your National Identity Card [Documento Nacional de Identidad/DNI] or any other document that attests to your identity, by attaching this to your communication by e-mail, in person or by ordinary mail, along with the right or rights you wish to exercise. 

Similarly, in any case where you consider that the handling and processing of your Data is in breach of statutory data-protection requirements, you have the right to bring a claim before any European Data Protection Authority (you can find the list here) including the Spanish Data Protection Authority [Agencia Española de Protección de Datos-AEPD], though we would strongly urge you to first allow us try and help you.

9. POLICY UPDATES

This Privacy Policy may be regularly updated to reflect changes in our Personal Data practices. Any change in the Policy will be announced 15 days in advance of any such change coming into effect. We will publish a prominent notice to notify you of any significant change in the Policy and will indicate at the top of the Policy when it was last updated. We recommend that you consult the Policy regularly.
